إذا صدر أمر بإحالة متهم بجناية إلى محكمة الجنايات ولم يحضر يوم الجلسة ، تؤجل المحكمة الدعوى لإعادة تكليفه بالحضور .
ويجوز أن تصدر أمرا بالقبض عليه إن كان مفرجا عنه .
