تحال الدعوى إلى محكمة الجنايات أو المستشار الفرد بناء على أمر من مستشار الإحالة .
ويتبع في الدعاوى التي ينظرها المستشار الفرد الأحكام والأوضاع المقررة أمام محاكم الجنايات ويكون له ما لرئيس محكمة الجنايات من سلطة في ذلك " .
