الأمر بالحبس الصادر من النيابة العامة لا يكون نافذ المفعول إلا لمدة الأربعة الأيام التالية للقبض على المتهم ، أو تسليمه للنيابة العامة إذا كان مقبوضا عليه من قبل .
ولا يجوز تنفيذ أوامر الضبط والإحضار وأوامر الحبس الصادرة من النيابة العامة بعد مضى ستة أشهر من تاريخ صدورها ما لم تعتمدها النيابة العامة لمدة أخرى .
