يقوم النائب العام بنفسه أو بواسطة أحد أعضاء النيابة العامة بمباشرة الدعوى الجنائية كما هو مقرر بالقانون .
ويجوز بأداء وظيفة النيابة العامة من يعين لذلك من غير هؤلاء بمقتضى القانون .
