تختص النيابة العامة دون غيرها برفع الدعوى الجنائية ومباشرتها ، ولا ترفع من غيرها إلا فى الأحوال المبينة فى القانون .
ولا يجوز ترك الدعوى الجنائية ، أو وقفها أو تعطيل سيرها إلا فى الأحوال المبينة فى القانون .
