فى غير الأحوال التى يكون فيها الإفراج واجبا حتما ، لا يفرج عن المتهم بضمان أو بغير ضمان إلا بعد أن يعين له محلا فى الجهة الكائن بها مركز المحكمة إن لم يكن مقيما فيها .
