لا يجوز الحبس الاحتياطى فى الجنح التى تقع بواسطة الصحف أو غيرها من طرق النشر إلا إذا كانت الجريمة تتضمن طعنا فى الأعراض أو تحريضا على إفساد الأخلاق أو إذا كانت من الجرائم المنصوص عليها فى المواد ١٧١ و ١٧٢ و ١٧٩ فقرة ثانية و ١٨٠ و ١٨١ و ١٨٢ من قانون العقوبات .
