يتمتع التوقيع الالكتروني والكتابة الالكترونية والمحررات الالكترونية
بالحجية في إثبات إذا ما توافرت فيها الشروط الآتية :
( أ ) ارتباط التوقيع الالكتروني بالموقع وحده دون غيره .
(ب) سيطرة الموقع وحده دون غيره على الوسيط الالكتروني .
(ج) إمكانية كشف أى تعديل أو تبديل فى بيانات المحرر الالكتروني أو التوقيع الالكتروني .
وتحدد اللائحة التنفيذية لهذا القانون الضوابط الفنية والتقنية اللازمة لذلك .
