لا تتحمل الدولة مسئولية ما يحدث من أضرار للأراضى أو المنشآت الواقعة داخل الأملاك العامة ذات الصلة بالموارد المائية والرى إذا كان الضرر ناشئا عن تغير منسوب المياه لأسباب طارئة أو تقتضيها أعمال موازنات الرى والصرف أو لارتفاع منسوب مياه البحر أو النوات متى قامت الوزارة باتخاذ الإجراءات والتدابير الوقائية اللازمة ، وذلك كله وفقا لقواعد المسئولية المنصوص عليها بالقانون المدنى .
