يحدد بقرار من رئيس مجلس الوزراء ، بعد موافقة مجلس الوزراء ، مقابل رفع المياه لرى الأراضى وصرف المياه منها بواسطة طلمبات الدولة وآلاتها وذلك ما لم يكن قد روعى فى تقدير ضريبة الأطيان انتفاع الأراضى بالري والصرف بغير مقابل . وتئول حصيلة هذه المبالغ إلى صندوق إعادة الشىء إلى أصله المنصوص عليه فى المادة (١١٤) من هذا القانون .
