مع عدم الإخلال بأية عقوبة أشد ينص عليها قانون العقوبات أو أي قانون آخر يعاقب بالحبس وبغرامة لا تقل عن عشرة آلاف ولا تجاوز مائة ألف جنيه أو بإحدى هاتين العقوبتين كل موظف عمومي مختص أخل عمدا بواجبات وظيفته مما ترتب عليه وقوع إحدى الجرائم المنصوص عليها في هذا القانون أو اتخاذ الإجراءات القانونية الواجبة في شأنها، وذلك فضلا عن الحكم بالعزل من الوظيفة مدة مساوية لمدة الحبس.
