استثناء من حكم المادة السابقة لا يجوز إثبات اسم الوالد أو الوالدة أو كليهما بالتبليغ وذلك في الحالات الآتية:
1- إذا كان الوالدان من المحارم فلا يذكر اسماهما.
2- إذا كانت الوالدة متزوجة وكان المولود من غير زوجها فلا يذكر اسمها.
بالنسبة إلى غير المسلمين إذا كان الوالد متزوجا وكان المولود من غير زوجته الشرعية فلا يذكر اسمه، إذا كانت الولادة قبل الزواج أو بعد فسخه.
