لكل ذي شأن أن يطلب إلى قاضي الأمور المستعجلة محو التأشير المشار إليه في المادة (31) فيأمر به القاضي إذا كان سند الدين مطعونا فيه جديا .
وكذلك لذي الشأن أن يطلب إلى القاضي محو التأشير المشار إليه في المادة (32) فيأمر به القاضي إذا تبين له أن الدعوى التي أشر بها لم ترفع إلا لغرض كيدي محض .
