يجب كذلك قيد جميع التصرفات والأحكام النهائية المقررة لحق من الحقوق العينية العقارية الأصلية . ويترتب على عدم القيد أن هذه الحقوق لا تكون حجة لا بين ذوي الشأن ولا بالنسبة إلى غيرهم .
ويسري هذا الحكم على القسمة العقارية ولو كان محلها أموالا موروثة .
