لا يجوز في غير حالة التلبس بالجريمة اتخاذ أي إجراء جنائي ضد عضو مجلس
الشيوخ في مواد الجنايات والجنح إلا بإذن سابق من المجلس. وفي غير دور الانعقاد يتعين
أخذ إذن مكتب المجلس، ويخطر المجلس عند أول انعقاد بما اتخذ من إجراء .
وفي جميع الأحوال، يتعين البت في طلب اتخاذ الإجراء الجنائي ضد العضو خلال ثلاثين يوما
على الأكثر، وإلا عد الطلب مقبولا .
