يقع باطلا كل نص يرد فى اتفاقية العمل الجماعية ويكون مخالفا لأحكام هذا القانون ، أو القوانين ذات الصلة .
وفى حالة تعارض نص فى عقد العمل الفردى مع نص فى الاتفاقية ، يسرى الحكم الذى يحقق فائدة كبرى للعامل .
