١ - تنتقل الحيازة للخلف العام بصفاتها ، على أنه إذا كان السلف سيء النية وأثبت الخلف أنه كان فى حيازته حسن النية جاز له أن يتمسك بحسن نيته.
٢ - ويجوز للخلف الخاص أن يضم إلى حيازته حيازة سلفه فى كل ما يرتبه القانون على الحيازة من أثر .
