على من يريد الأخذ بالشفعة أن يعلن رغبته فيها إلى كل من البائع والمشترى خلال خمسة عشر يوما من تاريخ الإنذار الرسمى الذى يوجهه إليه البائع أو المشترى و إلا سقط حقه . ويزاد على تلك المدة ميعاد المسافة إذا اقتضى الأمر ذلك .
