١ - إذا أبرم العقد لتنفيذ عمل معين انتهى بانقضاء العمل المتفق عليه .
٢ - فإذا كان العمل قابلا بطبيعته لأن يتجدد ، واستمر تنفيذ العقد بعد انتهاء العمل المتفق عليه ، اعتبر العقد قد تجدد تجديدا ضمنيا المدة اللازمة للقيام بالعمل ذاته مرة أخرى .
