١ - يجب على المقرض أن يسلم الشيء موضوع العقد إلى المقترض ، ولا يجوز له أن يطالبه برد المثل إلا عند انتهاء القرض .
٢ - وإذا هلك الشيء قبل تسليمه إلى المقترض كان الهلاك على المقرض .
