إذا تم العقد بطريق الإذعان ، وكان قد تضمن شروطا تعسفية جاز للقاضى أن يعدل هذه الشروط أو أن يعفى الطرف المذعن منها ، وذلك وفقا لما تقضى به العدالة ، ويقع باطلا كل اتفاق على خلاف ذلك .
