١ - تسرى النصوص التشريعية على جميع المسائل التى تتناولها هذه
النصوص فى لفظها أو فى فحواها .
٢ - فإذا لم يوجد نص تشريعى يمكن تطبيقه، حكم القاضى بمقتضى
العرف ، فإذا لم يوجد،فبمقتضى مبادئ الشريعة الإسلامية، فإذا لم توجد،
فبمقتضى مبادئ القانون الطبيعى وقواعد العدالة .
