تنتفى المسئولية الطبية فى أى من الحالات الآتية
:
1- إذا كان الضرر الواقع على متلقى الخدمة هو أحد الآثار أو المضاعفات الطبية المعروفة في مجال الممارسة الطبية المتعارف عليها علميا .
2- إذا اتبع مقدم الخدمة فى الإجراء الطبى أسلوبا يتفق مع الأصول العلمية الثابتة وإن خالف في ذلك غيره في ذات التخصص .
3- إذا كان الضرر قد وقع بسبب فعل متلقى الخدمة أو رفضه للعلاج أو عدم اتباعه للتعليمات الطبية الصادرة إليه من مقدم الخدمة .
