فيما عدا الدعاوى المستعجلة يجب على النيابة العامة أن تدخل فى الحالات الآتية و إلا كان الحكم باطلا .
( ١ ) الدعاوى التى يجوز لها أن ترفعها بنفسها .
( ٢ ) الطعون والطلبات أمام محكمة النقض ومحكمة تنازع الاختصاص .
( ٣ ) كل حالة أخرى ينص القانون على وجوب تدخلها فيها .
