إذا اتفق على اختصاص محكمة معينة يكون الاختصاص لهذه المحكمة أو للمحكمة التى يقع فى دائرتها موطن المدعى عليه .
على أنه فى الحالات التى ينص فيها القانون على تحويل الاختصاص لمحكمة على خلاف حكم المادة ٤٩ لا يجوز الاتفاق مقدما على ما يخالف هذا الاختصاص .
