يرفع طلب البطلان بالأوضاع المعتادة إلى المحكمة المختصة أصلا بنظر النزاع .
ولا يمنع من قبول هذا الطلب تنازل الخصم عن حقه فيه قبل صدور حكم المحكمين .
ويترتب على رفع الدعوى ببطلان حكم المحكمين وقف تنفيذه ما لم تقض المحكمة باستمرار هذا التنفيذ .
