يكون الاختصاص للمحكمة التى يقع فى دائرتها موطن المدعى عليه ما لم ينص القانون على خلاف ذلك .
فإن لم يكن للمدعى عليه موطن فى الجمهورية يكون الاختصاص للمحكمة التى يقع فى دائرتها محل إقامته .
وإذا تعدد المدعى عليهم كان الاختصاص للمحكمة التى يقع فى دائرتها موطن أحدهم .
