تخلف أحد ذوى الشأن عن الحضور في الجلسة لا يمنع من إجراء التسوية الودية بشرط عدم المساس بما أثبت للشأن المتخلف في القائمة المؤقتة .
ولا يجوز لمن تخلف أن يطعن في التسوية الودية التي أثبتها القاضى بناء على اتفاق الخصوم .
