إذا امتنع من عليه الإيداع جاز لكل ذى شأن أن يطلب من قاضى التنفيذ بصفة مستعجلة إلزامه به مع تحديد موعد للإيداع . فإذا لم يتم الإيداع خلال هذا الموعد جاز التنفيذ الجبرى على المتنع في أمواله الشخصية .
