يجوز للغير طلب بطلان إجراءات التنفيذ مع طلب استحقاق العقار المحجوز عليه أو بعضه ولو بعد انتهاء الميعاد المقرر
للاعتراض على قائمة شروط البيع وذلك بدعوى توقع بالأوضاع المعتادة أمام [غير مقروء]
قاضى التنفيذ ويختصم فيها من يباشر الإجراءات والمدين أو [غير مقروء]
أو الكفيل العينى وأول الدائنين المقيدين .
