يقوم قلم الكتاب بالنيابة عن ذوى الشأن بطلب تسجيل الحكم بإيقاع البيع خلال ثلاثة الأيام التالية لصدوره .
ويكون الحكم المسجل سندا بملكية من أوقع البيع عليه . على أنه لا ينتقل إليه سوى ما كان للمدين أو للحائز أو الكفيل العينى من حقوق في العقار المبيع .
