يلزم المزايد المتخلف بما ينقص من ثمن العقار و بالفوائد .
ويتضمن الحكم بإيقاع البيع إلزام المزايد المتخلف بفرق الثمن إن وجد ولا يكون له حق في الزيادة بل يستحقها المدين أو الحائز أو الكفيل العينى بحسب الأحوال .
