يتولى قاضى التنفيذ في اليوم المعين للبيع إجراء المزايدة بناء على طلب من يباشر التنفيذ أو المدين أو الحائز أو الكفيل العينى أو أى دائن أصبح طرفا في الإجراءات وفقا للمادة ٤١٧ ، وذلك بعد التحقق من إعلانهم بإيداع قائمة شروط البيع وبجلسة البيع .
وإذا جرت المزايدة بدون طلب أحد من هؤلاء كان البيع باطلا .
