يقدر قاضى التنفيذ مصاريف إجراءات التنفيذ بكاملها مقابل أتعاب المحاماة و يعلن هذا التقدير في الجلسة قبل افتتاح المزايدة ويذكر في حكم إيقاع البيع .
ولا تجوز المطالبة بأكثر مما ورد في أمر تقدير المصاريف ولا يصح على أية صورة اشتراط ما يخالف ذلك .
