يحصل البيع في المحكمة ، ويجوز لمن يباشر الإجراءات والمدين والحائز والكفيل العينى وكل ذى مصلحة أن يستصدر إذنا من قاضى التنفيذ بإجراء البيع في نفس العقار أو في مكان غيره .
