إذا كان التنفيذ على حصة شائعة في عقار فلكل دائن ذى حق مقيد رتب على أعيان مفرزة تدخل ضمنها تلك الحصة الشائعة أن يعرض رغبته في التنفيذ على تلك الأعيان المفرزة ويطلب بطريق الاعتراض على قائمة شروط البيع وقف إجراءات التنفيذ الخاصة بهذه الحصة .
ويحدد الحكم القاضى بوقف الإجراءات المدة التي يجب أن تبدأ خلالها إجراءات التنفيذ على الأعيان المفرزة .
