Article 343 of the Civil and Commercial Procedure Law

إذا لم يقرر المحجوز لديه بما في ذمته على الوجه وفي الميعاد المبينين في المادة ٣٣٩ أو قرر غير الحقيقة أو أخفى الأوراق الواجب عليه إيداعها لتأييد التقرير جاز الحكم على الدائن الذى حصل على سند تنفيذى بدينه بالمبلغ المحجوز من أجله وذلك بدعوى ترفع بالأوضاع المعتادة .
ويجب في جميع الأحوال إلزام المحجوز لديه بمصاريف الدعوى والتعويضات المترتبة على تقصيره أو تأخيره .
