يجوز للمحجوز عليه أن يطلب بصفة مستعجلة من قاضى التنفيذ في أية حالة تكون عليها الإجراءات تقدير مبلغ يودعه خزانة المحكمة على ذمة الوفاء للحاجز ، ويترتب على هذا الإيداع زوال الحجز عن الأموال المحجوزة وانتقاله إلى المبلغ المودع .
ويصبح المبلغ المودع مخصصا للوفاء بمطلوب الحاجز عند الإقرار له به أو الحكم له بثبوته .
