يكون إعلان خيار الملزم بالكفالة إما على يد محضر بورقة مستقلة وإما ضمن إعلان السند التنفيذى أو ورقة التكليف بالوفاء .
ويجب في جميع الأحوال أن يتضمن إعلان الخيار تعيين موطن مختار لطالب التنفيذ تعلن إليه فيه الأوراق المتعلقة بالمنازعة في الكفالة .
