على قلم كتاب المحكمة المرفوع إليها الاستئناف أن يطلب ضم ملف الدعوى الابتدائية فى اليوم التالى لليوم الذى يرفع فيه الاستئناف .
وعلى قلم كتاب المحكمة التى أصدرت الحكم أن يرسل ملف الدعوى خلال عشرة أيام على الأكثر من تاريخ طلبه وينقص هذا الميعاد إلى ثلاثة أيام فى الدعاوى المستعجلة . وتحكم المحكمة الاستئنافية على من يهمل فى طلب ضم الملف أو فى إرساله فى الميعاد بغرامة لا تقل عن جنيه ولا تجاوز عشرة جنيهات بحكم غير قابل للطعن .
