يجوز تصحيح الإجراء الباطل ولو بعد التمسك بالبطلان على أن يتم ذلك فى الميعاد المقرر قانونا لاتخاذ الإجراء ، فإذا لم يكن للإجراء ميعاد مقرر فى القانون حددت المحكمة ميعادا مناسبا لتصحيحه . ولا يعتد بالإجراء إلا من تاريخ تصحيحه .
