يعلن المدين لشخصه أو فى موطنه بالعريضة وبالأمر الصادر ضده بالأداء .
وتعتبر العريضة والأمر الصادر عليها بالأداء كأن لم تكن إذا لم يتم إعلانها للمدين خلال ثلاثة أشهر من تاريخ صدور الأمر .
