إذا رأى القاضى ألا يجيب الطالب إلى كل طلباته كان عليه أن يمتنع من إصدار الأمر وأن يحدد جلسة لنظر الدعوى أمام المحكمة مع تكليف الطالب بإعلان خصمه إليها .
ولا يعتبر رفض شمول الأمر بالنفاذ رفضا لبعض الطلبات فى حكم الفقرة السابقة .
