يجوز للمحكمة أن تحكم بالتعويضات مقابل النفقات الناشئة عن دعوى أو دفاع قصد بهما الكيد .
ومع عدم الإخلال بحكم الفقرة السابقة يجوز للمحكمة عند إصدار الحكم الفاصل فى الموضوع أن تحكم بغرامة لا تقل عن جنيهين ولا تجاوز عشرين جنيها على الخصم الذى يتخذ إجراء أو يبدى طلبا أو دفعا أو دفاعا بسوء نية .
