لا يجوز للمحكمة أثناء المداولة أن تسمع أحد الخصوم أو وكيله إلا بحضور خصمه ، أو أن تقبل أوراقا أو مذكرات من أحد الخصوم دون اطلاع الخصم الآخر عليها و إلا كان العمل باطلا .
