يجب تقديم طلب الرد قبل تقديم أى دفع أو دفاع وإلا سقط الحق فيه .
فاذا كان الرد فى حق قاضى منتدب لاجراء من اجراءات الاثبات، فيقدم الطلب خلال ثلاثة أيام من يوم ندبه اذا كان قرار الندب صادرا فى حضور طالب الرد، فان كان صادرا فى غيبته تبدأ الأيام الثلاثة من يوم اعلانه به.
ويجوز طلب الرد اذا حدثت أسبابه بعد المواعيد المقررة، أو اذا أثبت طالب الرد أنه لم يعلم بها الا بعد مضى تلك المواعيد.
