يقع باطلا عمل القاضى أو قضاؤه فى الأحوال المتقدمة الذكر ولو تم باتفاق الخصوم .
وإذا وقع هذا البطلان فى حكم صدر من محكمة النقض جاز للخصم أن يطلب منها إلغاء الحكم و إعادة نظر الطعن أمام دائرة أخرى
