الدفع بعدم قبول الدعوى يجوز إبداؤه فى أية حالة تكون عليها .
وإذا رأت المحكمة أن الدفع بعدم قبول الدعوى لعيب
فى صفة المدعى عليه قائم على أساس ، أجلت الدعوى لإعلان ذى الصفة ويجوز للمحكمة
فى هذه الحالة الحكم على المدعى بغرامة لا تقل عن خمسين جنيها ولا تجاوز مائتى جنيه .
واذا تعلق الأمر باحدى الوزارات، أو الهيئات العامة، أو مصلحة من المصالح، أو بشخص اعتبارى عام، أو خاص، فيكفى فى تحديد الصفة أن يذكر اسم الجهة المدعى عليها فى صحيفة الدعوى.

وإذا رأت المحكمة أن الدفع بعدم قبول الدعوى لانتفاء صفة المدعى عليه قائم على أساس ، أجلت الدعوى لإعلان ذى الصفة ويجوز لها فى هذه الحالة الحكم على المدعى بغرامة لا تجاوز خمسة جنيهات .
واذا تعلق الأمر باحدى الوزارات، أو الهيئات العامة، أو مصلحة من المصالح، أو بشخص اعتبارى عام، أو خاص، فيكفى فى تحديد الصفة أن يذكر اسم الجهة المدعى عليها فى صحيفة الدعوى.
