يلتزم السمسار العقارى بالتحقق من بيانات العقار أو الوحدة أو الأرض ، ويتأكد من المعلومات المقدمة من ذوى الشأن ، ويطابقها مع المعلومات الفعلية المسجلة لدى الجهات الإدارية سواء من حيث المساحة أو الوصف الصحيح .
كما يلتزم السمسار العقارى بالحفاظ على سرية المعلومات التى يتصل علمه بها ، بموجب الفقرة الأولى من هذه المادة ، وألا يفصح عنها إلا فى الحالات التى يسمح فيها القانون بذلك .
