يصدر بإنشاء الجامعة الأهلية قرار من رئيس الجمهورية،
بعد موافقة مجلس الوزراء، بناء على عرض الوزير المختص بالتعليم العالي.
وتكون للجامعة الأهلية شخصية اعتبارية خاصة من تاريخ إنشائها.
